RESTRICTIVE COVENANTS APPLICABLE TO THE FOREGOING LANDS

These protective restrictions and covenants are intended to be covenants running with the land, and shall be so constructed. These protective restrictions are covenants designed to improve the quality of life of the ownership of the affected lands, and are not intended to restrict the erection of permanent homes on the land, or to prohibit normal and usual agricultural pursuits and use thereof. However, the following are prohibited uses of the land:

  1. The land shall not be used for commercial hog or swine purposes.
  2. The land shall not be used for commercial chicken (poultry) farming.
  3. The land shall not be used for commercial dog kennels.
  4. No mobile home shall be placed upon the property. mobile homes are described as manufactured homes built which are transported to the property.
  5. The storage or keeping of inoperative automobiles, abandoned automobiles, trucks or machinery is prohibited, unless the same are enclosed in a four-wall and roof building of reasonably good appearance.
  6. The operation of used, wrecked or inoperative automobiles, junkyard, sale of automobile parts from used cars, trucks or other vehicles is prohibited.
The lands are intended to be used for residential purposes and/or general farming purposes, including timber growth and production. These restrictions shall be covenants running with the land according to a plat of said lands by Rymeg Consulting Group, Inc., dated June 2007, Drawing No.: 07143A, located in section 19, Township 5, Range 7; Section 20, Township 5, Range 7 and/or Section 30, Township 5 Range 3 in Jackson County, Alabama, and shall be enforceable by any party who acquired real estate from May Elizabeth Strickland, Michael Harrison Strickland, Harrison Jones Campbell, Joseph Andrew Campbell and Davis Allan Campbell or Section Gin & Grain Co, Inc. at a land auction conducted on June 30, 2007 by Horton Auction Company.
